PRELIMINARY

A) Field of application of the Code:

I – Commercial provisions:

Article 1 – The Turkish Commercial Code is an inseparable part of the Turkish Civil Code. The provisions included in this Code and the special provisions written in the other laws concerning transactions, acts and affairs related to any trading house, factory or establishment operated commercially, are commercial provisions.

In commercial affairs for which there is no any commercial provision, the court shall decide according to commercial customs, if even it is absent, according to general provisions.
