Objective, scope and basic principles

ARTICLE 1 – (1) The objective of this law; is the protection of the women, children and family members who have been subject to violence, or under the danger of being subject to violence and the individuals who have been victims of one-sided insistent stalking and is to regulate the procedures and principles for prevention of violence aimed at those persons.

(2) There shall be observed to the following basic principles in the implementation of this Law and in rendering of services required:

a) The Constitution of the Republic of Turkey, international conventions to which Turkey is a party, especially the Convention of the Council of Europe related to the Prevention of Violence and Domestic Violence Against Women and Struggle Against Them and other legal regulations that are in force shall be taken as basis.

b) There shall be followed a procedure that is based on basic human rights, sensitive to equality between women and men, in accordance with the social state principle, fair, effective and speedy in offering of support and services to be provided to victims of violence.

c) The decisions of injunctions taken about victims of violence and ones who commit violence shall be carried out in a manner that suits human dignity.

ç) Special measures within the scope of this Law which prevent sex-based violence against women and protect women from sex-based violence can not be interpreted as discrimination.
