Objective, Definitions and Principles


Article 1 – (As amended: on April 26,2006 – Act No:5491/1 st Art.)

The objective of this law is to ensure the protection of the environment which is common asset of all living things in line with sustainable environment and sustainable development principles.



Article 2 – (As amended: on April 26,2006 – Act No:5491/2 nd Art.)

From the terms took place in this Law;

“Environment” means the biological, physical, social, economic and cultural environment in which the living beings continue their relations and interact mutually throughout their lives,

“Environmental protection” means all the activities devoted to prevent destruction, deterioration and devastation of the environmental values ​​and ecological balance, to eliminate existing deteriorations, to better and improve the environment and to prevent environmental pollution,

“Environmental pollution” means any kind of unfavourable effect which occurs in the environement that may ruin the health of living things, environmental values ​​and ecological balance,

“Sustainable environment” means the process of refining, preserving and improving of all the environmental values ​​in every field (social, economic, physical etc.) that constitute the environment of today's and the future generations, without endangering the existence and quality of the resources that the future generations will need,

“Sustainable development” means development and improvement based on forming a balance among environmental, economic and social objectives that ensure today's and future generations live in a healthy environment,

“Receiving medium” means air, water, soil environments and ecosystems having relationship with these environments,

“Natural being” means all plants, animals, microorganisms and their environments,

“Natural resource” means the non-living beings exist in air, water, soil and nature,

“Pollutant” means real or legal persons who cause environmental pollution, deterioration of the ecological balancing and the environment directly or indirectly during or after their activities,

“Ecosystem” means the biological, physical and chemical system in which the living organisms performed their relationships with each other and with their inanimate environment in an order,

“Waste water” means water which has been contaminated or partially or totally altered as a result of domestic, industrial, agricultural and other usages,

“Waste water infrastructure facilities” means the sewerage system that collects domestic and / or industrial waste waters, and the system and the whole of the facilities through which waste water treated and returned to the receiving environement,

“Treatment plants” means the facilities where all kinds of wastes in form of solid, liquid and gas generated as a result of any kind of activity are treated in such a way as to provide the standards determined in by-laws,

“Ecological balance” means the whole of the conditions necessary to sustain the existence and development of human beings and other living things in accordance with their natural structures,

“Wetland“ means all waters, natural or artificial, permanent or temporary, its waters are still or flowing, sweet, bitter or salty, including depths not exceeding six meters in the withdrawal cycle of the tide movements of the sea, particularly water birds, all waters which are important for the environment of living beings, marshes, reed beds and turbaries and the sites that are ecologically remained as wetland towards the land side from the shoreline of these areas,

“Biological diversity” means the whole of ecosystems, species, genes and the relationships among them,

“Waste” means any kind of substance come into existence, thrown or left into environment, as a result of any activity,

“Solid waste” means solid waste materials which are wanted to be disposed by the manufacturer and which must be eliminated regularly with regard to the peace of community and the protection of the environment,

“Domestic solid waste” means solid wastes which do not fall within the scope of hazardous and harmful wastes, coming from the places such as residential, industrial, workplace, picnic areas,

“Hazardous waste” means wastes that cause deterioration of the ecological balance and natural structures of human and other living things by making negative effect in terms of physical, chemical and/or biologic aspects and materials that contaminated with these wastes,

“Hazardous chemicals” means all kinds of chemical substances and products that cause deterioration of ecological balance and natural structures of human and other living things by making negative effects in terms of physical, chemical and/or biological aspects,

“Dirty ballast” means ballast water which causes to be seen oil, petroleum derivation or oil marks on the water or adjacent shore line or creates color change on the water or under water or causes accumulation of suspended solid materials / substances in the emulsion state when placed on water from a standing or cruising tanker, ship or other sea vessel,

“Environmental impact assessment” means the studies to be continued in determining the probable positive and negative impacts of the planned projects on the environment, in determining the measures to be taken to prevent the effects that are in a negative way or to mimimize them to the extent that not to harm the environment, in definition and assessment of selected place and technology alternatives and in monitoring and controlling of the implementation of the projects,

“Project introduction file” means the file containing information and documents introducing the project with its general dimensions, including the location, characteristics, possible negative effects and thought measures of the project,that has been planned to be realized,

“Strategic environmental assessment” means environmental assessment studies which have been continued with a participatory approach to ensure the environmental values ​​to be integrated into the plan and program from the outset of the planning or programming process prior to the approval of the plan or program that is subject to approval, in order to ensure the environmental impact of the plan or program to be minimized and to asist the decision makers, including a written report as well,

“Environmental management” means the implementation of policies and strategies determined at local, regional, national and global level so as to ensure the sustainable use and development of natural and artificial environmental elements by using administrative, technical, legal, political, economic, social and cultural means,

“Environmental management unit / Environmental official” means the unit or official which assesses whether the activities of the facilities subject to audit are legal or not and the measures taken are being implemented or not and which organizes on-site annual inspection programs pursuant to this Law and the regulations put into force in accordance with it,

“Environmental volunteer” means the person who is elected from among the persons having appropriate qualities by the Ministry and charged with transferring the activities against the this Law and the regulations put into force in accordance with it,

“Sensitive area” means the coastal and inland water areas bearing a high risk of eutrophication and to be determined by the Ministry,

“Information related to the environment” means any kind of water, air, soil, plant and animal existence and the activities that adversely affect them and are probably to affect them, and written, oral or visual information or data present in relation to the administrative and technical measures taken,

“Business deadline plan” means the plan that shows the timing of the tasks such as site selection, project, auction, construction and starting-up which took place in the process of realization of the infrastructure facilites such as wastewater treatment plant and / or sewerage that should be done in order to provide the receiving body discharge standards specified in by-law and solid waste disposal facilities,

“Risk assessment” means the whole of the methods used to calculate with the aim of determination and the calculation of the results of the potential hazards of certain chemical substance or substances,

“Non-ionizing radiation” means the electromagnetic waves that do not cause ionization,

“Electromagnetic field” means the field formed by the waves which they have electric and magnetic field components,

“Odor” means the effect created by volatile substances which actuates sense of smell in humanbeing and causes perception of smell,

“Air quality” means the decreasing qualities with increasing quantities of the air pollutants present in the ambient air that are indicative of air pollution affecting humanbeing and his or her environment,

“Ministry” means the Ministry of Environment and Forestry.
